Terms of Service

Effective date: October 8, 2026

These terms are an agreement between you and Bubo2, Inc. ("Bubo²", "we"), 1111B S Governors Ave STE 23389, Dover, DE 19904, US. They govern your use of bubo2.com, app.bubo2.com, 3d.bubo2.com, the Bubo² viewer and embed, and everything else we provide (together, the "Service"). By creating an account or using the Service you accept these terms.

The short version

  • You own your content. We need a license to store, process, and serve it — that's what makes the Service work. Unless you opt out, we also use it to improve our algorithms.
  • You're responsible for having the rights to what you upload, and for what you publish.
  • Credits buy GPU processing. They have no cash value. Billing and refunds are governed by our Refund Policy.
  • Don't abuse the Service, other people's rights, or other people.
  • We provide the Service as-is; our liability is capped. Some jurisdictions give you rights these terms can't limit — those rights stay.

1. Your account and workspace

You must be at least 18 years old (or the age of majority where you live) to create an account. Keep your credentials secure; you're responsible for activity under your account.

Work in Bubo² happens in a workspace. A workspace's members share its content, its credit balance, and its subscription. Workspace admins control membership and billing. If you add members to your workspace, you're responsible for their use of it under these terms.

2. The Service

Bubo² turns photos and video you upload into hosted, interactive 3D Models, which you can present as Showcases (with Views, Hotspots, Transitions, and attached Content), group into Galleries, and share by link, embed, or public listing. We also provide free browser tools on 3d.bubo2.com.

We improve the Service continuously. Features may change, be added, or be removed. Where a change materially reduces what a paid plan includes, we'll give you notice before it takes effect.

3. Plans, credits, and billing

Paid plans are billed monthly through our payment provider's hosted checkout; we never see or store your card details. Plan prices, credit allocations, and limits are listed on our pricing page.

Credits buy GPU processing (1 credit = 1 GPU-minute). A Model build is charged at its fixed quality-preset price when the build starts; failed, cancelled, or timed-out builds are automatically refunded in full — only successful builds cost anything. Plan credits are valid for the billing month they're granted for and don't roll over; credit-pack credits never expire. Credits have no cash value, are non-transferable, and can't be redeemed for money except as described in the Refund Policy, which governs all refunds and your 14-day withdrawal right.

We may change prices and credit allocations. Changes to a subscription you already have take effect at your next renewal, with at least 30 days' notice.

If a recurring payment fails, your plan keeps working while our payment provider retries; if payment ultimately fails, your subscription ends and your workspace moves to the free plan. We never delete your Models over billing — downgrades and cancellations only affect what you can host publicly and how much processing you can run.

4. Your content

You keep ownership of everything you upload (photos, videos) and everything the Service creates from it for you (Models, Showcases, Galleries — together, "Your Content").

You grant us a worldwide, non-exclusive license to host, store, reproduce, process, adapt, and transmit Your Content to operate and provide the Service — for example: running reconstruction on your uploads, storing your Models, serving your published Showcases over our CDN, and rendering them in the viewer and embeds. For Showcases you make public or link-only, this license includes serving them to anyone with access. The license ends when you delete the content or your account, except for copies in routine backups (which expire on their own schedule), content you've published that others have lawfully retained, and content in the development dataset as described below.

Improving the Service. Unless your workspace opts out, this license also covers using Your Content — your uploads, the masks generated while processing them, and the resulting Models — together with processing telemetry, to improve the technology behind the Service: tuning our 3D reconstruction, and training and evaluating the machine-learning models that power features like automatic masking. Content used this way is kept in a separate, access-restricted development dataset. It is never published, never used in marketing, and never shown to other users, and models we train on it don't reproduce Your Content for anyone else. This can mean keeping copies of some uploads beyond the deletion schedule below. You can opt your workspace out at any time by emailing support@bubo2.com. When we receive your opt-out, or when you delete your account or workspace, we immediately stop using your content for Service improvement and remove your workspace's data from the development dataset within 30 days (models trained before then aren't affected retroactively).

You are responsible for Your Content. You confirm that you have the rights needed to upload and publish it — including, where applicable, permission to capture the property, objects, or people it depicts, and any consents required where you live. Don't upload content that is illegal, infringes someone's rights, or that you don't have the right to use.

Uploaded photos and videos are transient: we delete them automatically about 1 week after your Model finishes processing, or about 2 weeks after upload if no Model is created — apart from copies kept for Service improvement as described above. Models stay in your library until you delete them.

If you send us feedback or suggestions, we may use them without obligation to you.

5. Publishing and embeds

Showcases start private. Setting a Showcase to public or link-only makes it accessible to others — on 3d.bubo2.com, by link, and through embeds on third-party sites. Only public Galleries are discoverable. You can unpublish at any time.

Published Showcases count against your plan's hosted-Showcase allowance. When an allowance shrinks (downgrade, cancellation, or the free plan's 90-day window ending), affected Showcases keep serving through a 14-day grace period and are then unpublished — never deleted.

The public viewer displays Bubo² branding, except on plans that include white-label. You may embed your published Showcases on any site you control or have permission to use; you may not embed them in contexts that violate these terms.

6. Acceptable use

Don't use the Service to:

  • upload or publish content that is illegal, infringing, defamatory, or that violates others' privacy or publicity rights;
  • misuse the platform — probing or disrupting our infrastructure, circumventing limits or metering, scraping the Service, or reverse-engineering non-open-source parts of it;
  • abuse billing — payment fraud, chargeback abuse, or gaming free-credit programs (for example with duplicate accounts);
  • resell raw access to our processing or hosting as your own service (talk to us instead — we do partnerships);
  • harm minors in any way.

We may remove content or suspend accounts that violate this section. Where practical, we'll warn you first and give you a chance to respond; for serious violations (illegal content, fraud, attacks on the Service) we may act immediately.

7. Copyright complaints

If you believe content on the Service infringes your copyright, send a notice to legal@bubo2.com identifying the work, the infringing material's URL, your contact details, and a statement of good-faith belief, made under penalty of perjury, that you're authorized to act. Notices must be addressed to Bubo2, Inc., Attn: Copyright Agent, 1111B S Governors Ave STE 23389, Dover, DE 19904, US, Email: legal@bubo2.com. We handle notices under the DMCA, remove infringing material promptly, and maintain a policy of terminating accounts of repeat infringers in appropriate circumstances. If your content was removed and you believe that was a mistake, you may send a counter-notice.

8. Our IP and third-party services

The Service — including the platform, the viewer, and our branding — belongs to Bubo2, Inc. and its licensors. These terms give you a right to use the Service, not a license to any of it beyond that. Open-source components we distribute remain under their own licenses.

The Service interoperates with third-party services you choose to connect (for example, payment via our provider's hosted pages, or importing files from your cloud storage). Those services have their own terms, and we're not responsible for them.

9. Availability and support

We work hard to keep the Service available but don't promise uninterrupted operation. Processing times vary by plan and load; where a plan lists processing targets, they are targets — missing one doesn't entitle you to compensation unless your written agreement with us says otherwise. We may run maintenance, and we may suspend the Service where necessary to protect it or comply with law.

10. Ending the agreement

You can stop using the Service, cancel your subscription (it runs to the end of the paid month), or delete your account at any time. If you're the only member of your workspace, deleting your account also deletes the workspace: its subscription is canceled, and Your Content and personal data are deleted within 30 days. In a workspace with other members, you can leave the workspace, or a workspace admin can remove you (we'll tell you by email); the content you contributed stays with the workspace. If an admin deletes a workspace, every member is notified by email and the workspace's content is deleted within 30 days. Your account and personal data are deleted within 30 days after your last workspace membership ends. In each case, records we must keep (like billing history) are retained, and backup copies expire on schedule. Export your Models before deleting.

We can suspend or terminate your access for material breach of these terms, and we'll tell you why unless the law prevents it. We can also stop providing the Service altogether with at least 90 days' notice, in which case we'll refund any prepaid, unused amounts.

Sections that by their nature should survive (Your Content licenses already exercised, disclaimers, liability limits, disputes) survive termination.

11. Disclaimers and liability

The Service is provided "as is" and "as available." To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. 3D reconstruction quality depends heavily on your capture; we don't guarantee any particular result.

To the extent the law allows: we're not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, revenue, or data; and our total liability for all claims in any 12-month period is capped at the greater of $100 or the amounts you paid us in those 12 months.

Nothing in these terms limits liability that can't be limited by law — including, for consumers in the EU/UK and elsewhere, statutory rights that local law makes mandatory. Those rights stay intact.

You'll indemnify us against third-party claims arising from Your Content or your breach of these terms, to the extent permitted where you live.

12. Disputes and governing law

These terms are governed by the laws of the State of Delaware, US, excluding its conflict-of-law rules — except that if you're a consumer, you also keep the protection of the mandatory consumer laws of the country where you live, and you may bring proceedings in your local courts. Otherwise, disputes belong to the state or federal courts located in Delaware.

FOR UNITED STATES RESIDENTS: PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR RIGHTS. You and Bubo2, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by BINDING INDIVIDUAL ARBITRATION administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU AND BUBO2, INC. AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. You have the right to OPT OUT of this arbitration agreement within 30 days of first accepting these terms by emailing legal@bubo2.com.

13. Changes to these terms

We may update these terms. For material changes we'll give at least 30 days' notice (email or in-app). If you don't agree with a change, stop using the Service before it takes effect — continued use afterwards means you accept it. The current version always lives at bubo2.com/legal/terms.

14. Miscellany

If part of these terms is unenforceable, the rest stands. Our not enforcing a term isn't a waiver. You can't assign this agreement without our consent; we may assign it in connection with a merger, acquisition, or sale of assets. These terms plus the Refund Policy and Privacy Policy are the entire agreement between us about the Service, together with any separate written agreement we've both signed (for example, an enterprise or managed-service contract), which prevails over these terms where the two conflict.
